Unless stated otherwise herein, the relationship between Bag Spa and its Users is exclusively governed by these Terms and Conditions that are deemed read and accepted by the User. If you do not agree to these terms and conditions in their entirety, please do not use the Site.

From time to time, when you purchase products on this Site, you may receive additional guidelines, rules and policies applicable to such services and products, all of which are hereby incorporated by reference and will apply to your use of the Site.

Bag Spa may from time to time amend the Terms and Conditions by posting such changes on the Site. Use by you after such changes have been posted shall constitute acceptance of such changed terms.

Bag Spa is a part of Shoe Spa London (company number) and is the seller of the product on the site. Bag Spa & Shoe Spa has its registered office at 80 Caledonian road, N1 9DN London.

3. Accuracy of content

Bag Spa uses its best efforts to keep the information on the Site updated. However, it is not possible to guarantee the complete absence of errors on the Site. The information and other material published on this Site may include inaccuracies or typographical errors. The weights, dimensions and volumes of the products are approximate only. We have made reasonable efforts to ensure that product information is accurate and to display as accurately as possible the colours of our products. However, we cannot guarantee that your screen’s display will accurately reflect the colour of the product on delivery. Changes are periodically made to the information on the Site without notice to you. Bag Spa reserves the right to change the Site at any time, in its discretion. Bag Spa does not warrant that the functions contained in the Site, or any materials or content contained therein will be uninterrupted or error free, that defects will be corrected, or that the Site or the server that makes it available is free of viruses or other harmful components. Bag Spa shall not be liable for the use of the Site, including, without limitation, the content and any errors contained therein.

All products are pre-owned (second hand) unless stated otherwise.

Images are for illustration only. Actual item design may vary or the item may carry marks unseen in the image(s).

Each product purchased is sold subject to its product description which sets out additional specific conditions related to that product including, without limitation, terms and conditions concerning estimated delivery dates and times, warranties, after-sales service and guarantees.

Please note, however, that all product descriptions and images are for display purposes only and do not represent the finished product. Additional elements such as extra straps or a dust bag are subject to availability.

We will take all reasonable care to ensure that all details, descriptions, and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the website as up to date as possible, the information including product descriptions appearing on this website at a particular time may not always reflect the position exactly at the moment you place an order.

4. Prices

The price of the products you order is the price that is displayed on the Site at the time you confirm your order and will be confirmed on the e-mail confirmation confirming receipt of your order. All prices are in £, inclusive of VAT and forwarding charges.

If an error is found in the price of the products you have ordered or in the delivery charge, we will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order.

5. Online Ordering

You can place an order if you are an adult aged 18 or over. The ordering process consists of following steps:

•  For placing an order, you need to fill a small form, once we receive your request, we will email you the payment and delivery information. Bag Spa does not sell products for children, but it sells them to adults, who can purchase with an accepted method of payment. If you are under 16, you may use the Site only with involvement of a parent or guardian. Bag Spa and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

•  You select your purchase

•  You choose your delivery method.

•  You provide the delivery address.

•  You will provide your billing address together with the payment information.

•  You will be asked to accept the Terms and Conditions.

•  Before you make the payment, you will be given the opportunity to review your selection, check the total price of your order including the shipping charges.

After making the payment, we will send you an e-mail confirming receipt of your order. At that time.

If you pay by credit card, you will receive an e-mail containing your payment status.

As soon as the goods are shipped, you will receive a notification (the “Shipping Notification E-mail”). All orders are subject to availability of the products at the time of dispatch.

We reserve the right to cancel your order for any reason.

Buying from Bag Spa and selling to Bag Spa are separate transactions.

6. Payment

Bag Spa accepts payments via bank transfer, or we can also provide a payment link to pay with a valid UK credit card, debit card. Payment must be made in £. Please refer to the Privacy Policy posted in the Site for further information regarding internet fraud and secure payment.

Bag Spa retains title in the sold goods until we have received full payment of the price and shipping charges, and possible late payment interests and/or indemnities. You must pay the Price within 1 day of the date of our invoice or otherwise according to any credit terms agreed between us. You must make payment even if delivery has not have taken place and / or that the title in the Goods has not passed to you.

7. Sale contract


No sale contract will exist between you and Bag Spa until Bag Spa dispatches the products. All information on our website is an invitation to treat only and is not an offer or unilateral contract. Your order represents a binding offer by you to purchase our products. The sale will only be binding on us once we have notified you by means of the Shipping Notification E-mail that the goods have been dispatched to you.

Bag Spa reserves the right to refuse an order, wholly or partially, in the following cases:

•  If the product is not available;

•  If your billing information is not correct or not verifiable;

•  If your order is flagged up by the security systems as an unusual order or an order susceptible of fraud;

•  If your bank transfer payment/reservation is not received timely;

•  If we have reason to believe you are under 18;

•  If we have reason to believe you are a reseller;

•  If there was an error in the price quoted;

•  If we could not deliver to the address provided by you;

•  In the event of force majeure.

8. Delivery restrictions – country of delivery

Care of PO Box addresses and military APO addresses are not accepted.

We deliver from Monday till Friday on our Next Working Day & 2 Working Day delivery options, except for bank holidays.

Through our Site the products are delivered in the UK and Europe.

9. Delivery

We will use all reasonable efforts to deliver the products ordered within the timescales indicated on the individual order confirmation to the User. Such timescales are not guaranteed delivery times and should not be relied upon. Erroneously communicated addresses are the responsibility of the User and may lead to extra charges that will be recovered from the User.

All goods will be dispatched from Bag Spa. If your product is not delivered within the specified timescale, please contact us with your order reference.

9.1 WE ARE NOT RESPONSIBLE FOR DELAYS OUTSIDE OUR CONTROL

Once the item has left our warehouse / store / any other deemed location, the courier is responsible. We insure our parcels so that if anything were to be lost or stolen, we can offer the buyer a full refund and make the claim from the courier. You as a buyer are entitled to notify us of a delayed shipment, but Bag Spa as a company is not obliged to contact you regarding delays to your shipment.

9.2 COLLECTION BY YOU

If you have requested to collect the item from our London Store, you are welcome to collect any time between the hours of 11am-7pm on weekdays (Excluding bank holidays).

9.3 Defective product or wrong delivery

You must check whether your shipment is correct upon delivery. If there are discrepancies or problems with your order, you must inform us of any delivery issues within 72 hours of receiving confirmation of your shipment. Please email us at office@bag-spa.co.uk, but for faulty goods or goods being returned due to our error we will also refund any cost incurred in returning the item. Subject to availability, we will send you a new Shipping Notification E-mail and we will automatically and immediately ship to you at our own costs the correct replacement product. All items unless stated otherwise are sent on a Next Working Day Service.

10. Returns

If you have decided to return your order, you must follow the 14 days return policy. Bag Spa will be unable to accept a return that was requested post the 14 days since the order was placed.

Returned products must be in the same condition as sent out, unworn and with all tags still attached & in the original packaging.

For hygiene purposes, no refunds or exchanges will be given for products that have perfume, makeup, body odours or cigarette smoke on. Any objects found within the returned item or inside of pockets will be seen as evidence of use.

Any item that doesn’t meet the criteria set out in the return policy will be rejected and returned to the sender. Please note you could be asked to cover the delivery cost of rejected items.

You bear the risk and cost of returning the Goods.

10.1 YOU ARE ENTITLED TO REQUEST FOR A REFUND IF

10.2 Processing your refund:

Once we have received your returned item and it has passed our returns criteria, we will process your refund right away.

Funds can take between 5-7 working days to return to your account depending on payment method used and who you bank with.

If you have any issues with your item or problems in getting the item back to us within the required time frame, please get in contact with us as soon as possible. Decisions on processing refunds outside of the 14-day return period will be at our discretion.

10.4 QUALITY CONTROL FOR RETURNS

Bag Spa will inspect and compare images of the item after the arrival of a return. Quality control checks include ensuring the item was in the exact same condition as it was shipped out in. Bag Spa provides labels and tags for products that must remain in-tact when the item arrives at Bag Spa. If an item arrives at Bag Spa and is not in the condition it was shipped out in, or the tags/labels are removed, the buyer will not be refunded and will be welcome to collect the product they initially purchased from the London store, or they are welcome to pay for shipping to the preferred address.

OUR TOTAL LIABILITY IN RESPECT OF THE PRODUCT OR ANY BREACH, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), BREACH OF STATUTORY DUTY OR OTHERWISE, INCLUDING LOSS OR DAMAGE DURING COLLECTION, STORAGE OR RETURN, SHALL NOT IN ANY EVENT EXCEED THE VALUE OF THE RELEVANT ORDER.

WE ARE NOT LIABLE FOR BUSINESS LOSSES. WE ONLY SUPPLY THE PRODUCTS FOR DOMESTIC AND PRIVATE USE. IF YOU USE THE PRODUCTS FOR ANY COMMERCIAL, BUSINESS OR RESALE PURPOSE WE WILL HAVE NO LIABILITY TO YOU FOR ANY LOSS OF PROFIT, LOSS OF BUSINESS, BUSINESS INTERRUPTION, OR LOSS OF BUSINESS OPPORTUNITY.

OTHER IMPORTANT TERMS

NOBODY ELSE HAS ANY RIGHTS UNDER THIS CONTRACT (EXCEPT SOMEONE YOU PASS YOUR GUARANTEE ON TO). THIS CONTRACT IS BETWEEN YOU AND US. NO OTHER PERSON SHALL HAVE ANY RIGHTS TO ENFORCE ANY OF ITS TERMS.

EACH OF THE PARAGRAPHS OF THESE TERMS OPERATES SEPARATELY. IF ANY COURT OR RELEVANT AUTHORITY DECIDES THAT ANY OF THEM ARE UNLAWFUL, THE REMAINING PARAGRAPHS WILL REMAIN IN FULL FORCE AND EFFECT.

EVEN IF WE DELAY IN ENFORCING THIS CONTRACT, WE CAN STILL ENFORCE IT LATER. IF WE DO NOT INSIST IMMEDIATELY THAT YOU DO ANYTHING YOU ARE REQUIRED TO DO UNDER THESE TERMS, OR IF WE DELAY IN TAKING STEPS AGAINST YOU IN RESPECT OF YOUR BREAKING THIS CONTRACT, THAT WILL NOT MEAN THAT YOU DO NOT HAVE TO DO THOSE THINGS AND IT WILL NOT PREVENT US TAKING STEPS AGAINST YOU AT A LATER DATE. FOR EXAMPLE, IF YOU MISS A PAYMENT AND WE DO NOT CHASE YOU BUT WE CONTINUE TO PROVIDE THE PRODUCTS, WE CAN STILL REQUIRE YOU TO MAKE THE PAYMENT AT A LATER DATE.

WHICH LAWS APPLY TO THIS CONTRACT AND WHERE YOU MAY BRING LEGAL PROCEEDINGS. THESE TERMS ARE GOVERNED BY ENGLISH LAW AND YOU CAN BRING LEGAL PROCEEDINGS IN RESPECT OF THE PRODUCTS IN THE ENGLISH COURTS. IF YOU LIVE IN SCOTLAND YOU CAN BRING LEGAL PROCEEDINGS IN RESPECT OF THE PRODUCTS IN EITHER THE SCOTTISH OR THE ENGLISH COURTS.

11. Right to cancel

You have the right to retract/cancel from the sale contract within 14 days without giving any reason.

The retraction/cancellation period will expire: (i) after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the products; or (ii) in the case of a sales contract relating to multiple products ordered by you in one order and delivered separately, after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last of the products.

To exercise the right of retraction/cancellation, you must inform us of your decision to cancel this contract by a clear statement (via email).

We will communicate to you an acknowledgement of receipt of such a cancellation by email without delay.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

Effects of cancellation

If you retract/cancel from the sale contract, we will reimburse to you all payments received from you, excluding the cost of delivery.

We make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling from you.

We will make the reimbursement without undue delay and not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

You should return the goods to us in the manner directed by us. Risk of loss and title for goods remains with the customer until received by Bag Spa. This means that such risks pass to us only on delivery to us, by the carrier. Bag Spa recommends the use of an insured/traceable method of transit for goods being returned to us, such as Royal Mail Special delivery or Recorded delivery.

All items will be despatched to you bearing a Quality Control label. Once removed, the goods will be deemed to have been accepted by you and not eligible for return or the order cancelled. This does not affect your statutory rights as a consumer.

12. Limitation of Liability

The terms and conditions of this sale contract do not affect your statutory rights. We will not be liable for any damages (including without limitation loss of profit or loss of use) arising out of your use or delay or inability to use our Site, its content or any link to another website arising in contract, tort (including negligence) or otherwise, except in the case of death or personal injury caused by our negligence or wilful misconduct.

We will not be liable to you by way of representation (unless fraudulent), common law duty or under any express or implied term of the sale contract for:

(a) any losses which are not foreseeable by both parties to the sale contract at the time such sale contract is formed arising in connection with the supply of the products and related service or their use by you;

(b) any losses which are not caused by any breach by us;

(c) business or trade losses.

We will not be liable to you for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Site.

Our entire liability in connection with the sale contract will not exceed the current market value of the goods in question.

bag Spa is under a legal duty to supply the ordered products that are in conformity with the sale contract.

13. Entire Agreement

These Terms and Conditions supersede all prior terms applied with the User.

Terms & conditions- Sell

The terms and conditions set forth below constitute a contract between you the customer and Bag Spa (the “Agreement”).  Please thoroughly review the terms of this Agreement.  You must agree to the terms of this Agreement to sell/consign goods with Bag Spa.

Bag Spa’s Terms of Service located at: www.bag-spa.co.uk are also included in this Agreement and apply to your and Bag Spa’s activities under this Agreement.

Once you agree to the terms of this Agreement, it will remain in effect until termination by you or Bag Spa.

By agreeing to the prices shown before you in the PDF format, you hereby are agreeing to our Consignment Terms. 

  1. ONLINE OFFERS

All offers will be based on Shoe Spa’s own determination of the item(s) value in reliance on the accuracy of the information you supply us. Bag Spa will use its discretion to determine the item(s) value, weighing factors that may include the item(s) model, functionality, size, age, and condition and whether necessary item(s) accessories have been provided by you. Your Online Offer will be valid for fourteen (14) days. If we fail to receive your item with in fourteen (14) days you may need to open another transaction with us at which point, assuming the Item(s) is still eligible for purchase, the new offer may be different as Item(s) prices are subject to change.

When packaging your item(s) be sure to include all materials included in your description, when we calculated your offer. This may include particular accessories. Failure to include any item(s) you told us about when the offer was calculated or sending us an item(s) which does not match your original description, may impact the final value of your item(s) and may result in a revised offer. 

Packing and shipping recommendations provided to you by Bag Spa should be followed in order to avoid possible damage to or loss of the Item(s) in transit.

Upon its physical possession of the item(s), Bag Spa will inspect the item(s) to assess its authenticity, condition, and identify any undeclared damage.  At its sole discretion, Bag Spa will determine the item(s) authenticity, quality, and value.  The condition of the item(s) will affect its valuation.

Bag Spa has the option to accept or reject the item(s), including without limitation, to reject any Item(s) not conforming to the description you provided to us, any item(s) modified in such a way that it no longer conforms to the original factory specifications, any item(s) no longer complying with applicable laws or regulations and/or any item(s) damaged or lost in transit. If Bag Spa rejects the item(s) for any of these reasons, the original offer automatically expires and is rescinded. Bag Spa reserves the right to revoke the original offer and provide a revised offer for the item(s) if: (a) the item(s) and/or materials are not as described,(b) the item(s) is received by Bag Spa after the Delivery Period, and/or (c) Bag Spa receives item(s) that are different from those identified when your offer was calculated

In the event Bag Spa recalculates the offer it provided for the item(s) after it has been received and inspected, as described above, you shall have the option of accepting or rejecting the new offer. If you accept the new offer, you will be paid in normal course and in accordance with these service terms.

If you reject the offer or we are unable to accept the item Bag Spa will return the item(s) to you at the charge of £8 (UK Mainland only) at the address from which it was originally sent. Bag Spa will give you a period of five (5) days after Bag Spa presents you with are calculated offer via email at the address you provided to accept or reject the new offer. Bag Spa will also remind you of the outstanding new offer one or more times during the New Offer Period.

Bag Spa shall not be responsible for communication errors should your contact information be inaccurate or incomplete. You are responsible for ensuring that you can receive emails from Bag Spa, and Bag Spa is not responsible for any emails that were not received by you because they were blocked or filtered as spam. You understand and agree that if you fail to provide us with accurate and up to date information about yourself. We will not be responsible for any misapplied payments or payments sent to a wrong address.

Item(s) Eligibility: Bag Spa determines in its sole discretion, which item(s) are eligible for purchase by or through the Bag Spa Services and for which eligible item(s) Bag Spa will provide an offer. Bag Spa may terminate the eligibility of certain item(s) at any time and without advanced notice.

Do not submit item(s) that are non-operative or with physical damage that inhibits use. The above definitions are broad guidelines, more specific condition definitions specific to the category and or type of item(s) may be included on the Bag Spa Website offer screen and serve as the effective condition definition for that item(s). Condition definitions are subject to change at Bag Spa’s discretion. If you are uncertain about your Item(s)’s condition, please seek guidance by contacting us at office@bag-spa.co.uk

Bag Spa only accepts fully authentic Item(s). Once received, our team of experts will go through a thorough authentication process. Our experts have multiyear experience in luxury fashion and in the brands carried by Bag Spa. They are extremely knowledgeable and will find out counterfeits.

If your bag is identified as Counterfeit, we reserve the right to pass this over to the required authority and NOT return the item(s) to you. All Item(s) deemed as UNAUTHENTIC will be handed to the required authority or destroyed 14 days after we have informed you the bag is unauthentic. If you would like this item returned to you there will be a charge. This is inclusive, but not limited to, Shipping costs, Authentication and Time which must be paid prior to the bag being sent back to you.

Upon receiving an offer, you have the option of accepting or rejecting that offer. Acceptance indicates you are willing to sell your item(s) to/with Bag Spa at the offered price. If you do not accept Bag Spa’s offer or fail to respond, the specific transaction expires after five (5) days. If after rejecting the offer you change your mind and want to accept the offer, you may need to open another transaction with us at which point, assuming the Item(s) is still eligible for purchase, the new offer may be different as Item(s) prices are subject to change.

We reserve the right to destroy any physical paper work sent to us relating to your item, including receipts as these hold your personal data. We do not recommend receipts or paper work containing personal or financial details are sent with your item. 

All Offers from Bag Spa to purchase submitted Item(s) are non-binding and indicative only. Bag Spa reserves the right, at its sole discretion and at any point in time to cancel any Offer or Consignment Agreement. If you have accepted an offer and change your mind prior to the Title of Property has transferred and would like to request a cancellation Bag Spa reserve the right to deny this request. In the event your cancellation request is accepted you will incur a charge of a minimum of £7.95, this will increase depending on where in the Buying process up to the value of £60- £100, plus any charges incurred for any cleaning and restorative work carried out on your item and the full retail value.

Details of your specific Consignment terms will be provided to you as part of your Assessment. Until these are returned to us signed your item(s) will be considered as still under Assessment and Assessment Terms and Conditions will apply. 

Once accepted and your item(s) is available for sale with us you are insured up to the value the amount listed in your consignment agreement minus our consignment fee.

In the event your consignment agreement ends, and you have not notified us that you would like to collect your bag, your consignment agreement will automatically renew on a 30-day term. In the event you or we do not intend to renew the agreement you will be notified to collect your bag or a delivery can be arranged which may incur a delivery charge.

The Sale of your item will be subject to a 10 day cooling off period, should the order be cancelled by either ourselves or the clients, or returned to us with in those 10 days this will not constitute as a sale. After the 10-day cooling off period has lapsed and your item has not been returned or the order cancelled you will be contacted to organise payment. 

In the event your bag/s are on consignment and our selling price is £6000 and above you will only be eligible for payment until the returns period has lapsed and the bag has NOT been returned. 

Bag Spa are able to carry out any cleaning and restorative work required to your item(s) prior to the item being available for sale or at any point while listed for sale with us.

Bag Spa may increase the selling price of your bag at its discretion with our informing you. For consignment item(s) you will still receive the percentage listed with in your specific Consignment terms minus the cost of the repairs carried out.

We can offer discount with your approval, up to 10% off any item. This will impact the commission on both parties if applied.

If we are unable to get in touch or contact a consignor for any reason, the property will become Bag Spa’s property or will be donated to charity. Please update your information with us if any changes occur. 

Bag Spa complies with government laws of sales and returns periods. We offer our buyers a 14-day return window. If the item being returned is in any other condition other than what it was sent out in, then Bag Spa is eligible to cancel the refund process. Consignors must await the refund period in order to see their sales on their account. If an item is in the returns period, it will show up as “Pending” on their statements.

Cash – You will continue to own and have title to each item(s) until the BACS payment has been processed or your E-Wallet has been updated with the appropriate funds.

Consignment – You will continue to own and have title to each item(s) of Property until that Item(s) is “Sold“. All Item(s) will be considered Sold when: it is sold by Bag Spa to a customer and not returned to Bag Spa within the 14 days return window. or it is lost, stolen, damaged, or destroyed while in Bag Spa’s possession.

If we are unable to get in touch or contact a consignor for any reason, the property will become Bag Spa’s property or will be donated to charity. Please update your information with us if any changes occur. 

The length of time required to properly carry out Our Assessment can vary from a couple of days to a maximum two weeks.

Whilst your item(s) is in our care you are insured up to the Full item(s) Value, Depreciated Value or our Maximum Liability, whichever is the lesser, minus the cost of our Assessment. This is to cover you should your item(s) become lost, stolen or damaged beyond repair. Item(s)s in our care are;

Any item(s) currently under Assessment , or waiting for an Assessment to be carried out.

Any item(s) waiting for You to collect from Us will be in our care for a maximum period of 21 days.

Any item(s) you leave in our shop(s) or post to us will be held in our care for a maximum period of 21 days and will only be deemed in our care when we acknowledge receiving it.

9a) EXCLUSION TO LIABILITY – BAGS FOR ASSESSMENT ONLY

Customers using our Standard DPD home collection are covered by DPD up to £100. Clients using our Additional insurance home collection service will be offered the option to add on additional extended liability. The Insurance is provided by DPD and not Bag Spa, although Bag Spa will assist a client in making a claim.

If you DO NOT collect or accept delivery of Your item(s) within 21 days of being notified by Us that it is ready to collect/deliver, we will not be held responsible in any way for your item(s). The 21 day period for item(s) left in our shop(s) or posted to us will commence on the day you are informed the item(s) ready for delivery or collection and we will not be held responsible in any way for your item(s)thereafter.

When collecting your item(s) you must provide the reference number(s) for your item(s) and have suitable ID.

Bag Spa reserve the right to transfer your item(s) into storage if not collected within 21 days of being notified your item(s) is ready for collection or you fail to respond to our communication to complete your offer. If your item(s) is placed into storage a charge of a minimum of £14.95 will be incurred. Items not claimed in 12 months may be disposed of these will be disposed of in the most sustainable way determined by our team of experts. 

The disclaimers and limitations above are a fundamental part of the basis of bag spa’s business and bag spa would not enter into this agreement without them.
